British weather has always dominated conversation, never more so than in the farming industry. The recent sunshine and showers has caused havoc in planning to harvest, with farmers seizing every opportunity to get out on the combine when the sky turns blue for long enough. But beware, a recent case reported by the Farmers Weekly detailed a motorbike incident where a woman has been awarded £10,000 in compensation due to a farmer leaving mud on the road.
The hasty harvest has led to an increase of mud in gateways as farmers rush to fields to get the crops in before the ground itself has dried out. The farmer has a duty of care to ensure that the hazard is either well indicated or that every effort has been made to clear the road afterwards. In this particular case, it was alleged that the farmer had made no effort to warn motorists of the hazard, nor had he made any effort to remove the hazard. As a result of the incident, the insurers admitted to a breach of duty of care on behalf of the farmer.
This is a reminder to all those who are leading corn along public highways, that your liability doesn’t necessarily stop at the farm gate.
